SELF CHECK-IN FORM
1. Check-in Tour information
Are applied for the booking of bus tickets, train tickets and rental car, tour package provided by us as a travel agent and tour operator. By making the payment you accept these terms and conditions. In these Terms & Conditions, the word “Customer” means the person who agrees to buy and/or any person on whose behalf you agree to purchase the package tours, day trips, flights, car rental and other travel services provided by us.
2.1 DURATION
The tour services shall be provided for the period specified in the tour itinerary.
2.2 PAYMENT
The Customer agrees to pay the Service Provider the total amount as specified in the tour itinerary. Payment shall be made in USD/VND and must be received by the Service Provider before the commencement of the tour.
2.3 CANCELLATION
All cancellations must be received in writing, sent to us via Whatsapp message or email.
- Greater from 30 to 16 days prior to departure 50% of full amount plus any bank fees that result from us here and any charge that occurs to us from our service providers.
- Less than 15 days prior to departure you will lose your full deposit.
There will be no refund given for any unused or missed ground arrangements, sightseeing, meals or hotel accommodations. For no-show cases full amount will be charged.
In the unlikely event that such circumstances should arise we will contact you immediately and offer you the choice of an alternative of equivalent quality or a full refund of all money paid. No additional compensation will be paid over and above the total sum received from you.
We reserve the right to cancel the contract between us for any reasons to your payment of the full price of the holiday.
2.4 AMENDMENTS
Any amendments or changes to the tour itinerary must be agreed upon in writing by both parties and will have no refund if you change from Easyrider package to Self-riding package.
2.5 REFUND OF UNUSED SERVICES No refunds or exchanges can be made in respect of services which are included in the price but not utilized by the customer, such as there will be no refund given for any unused or missed ground arrangements, sightseeing, meals or hotel accommodations. For no-show cases full amount will be charged.
2.6 ACCEPTANCE OF BOOKING
We reserve the right to decline your booking without explanation if we have cause to believe that you might pose a threat to public safety or security in Vietnam.
We reserve the right to adjust the itinerary or to substitute hotels or to cancel a tour prior to departure without prior notice or will take no responsibility for any loss due to group dynamics, weather condition, governmental or police action, traffic jam or other conditions dictate. We require you to take out travel insurance and any other necessary insurances adequate to meet your needs and will assume that you will have done so before your arrival in Vietnam.
2.7 FORCE MAJEURE
If as a consequence of “Force Majeure” (as defined below), We is obliged to curtail, alter, extend or cancel the Tour, you shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of said curtailment, alteration, extension or cancellation of the Tour.
“Force Majeure” means Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, destruction or damage to holiday accommodation, riots, acts of war, civil commotion, exercise of legislative or government action, municipal or military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service connected with the Tour, fraud perpetrated against US.
2.8 TRAVEL DOCUMENTATIONS
All Customers must be in possession of a valid passport and necessary visas or permits at the commencement of travel. All such documentation is the sole responsibility of the client. Your travel advisor may assist you in applying for the necessary travel documentation upon request. We accept no responsibility or liability whatsoever for the failure of clients to obtain appropriate documentation.
2.9 INSURANCE
Since Bus tickets, Tour and car rental price are exclusive of insurance, you are required to obtain your own full travel insurance. It is your responsibility to read your insurance policy before you travel and ensure that the insurance scheme provides you with the requisite level of cover.
Damage insurance for motorbike cover for motorbike only. If the crash makes the motorbike be broken and can not be used or you do not want to ride a motorbike, party B will pay for transfer motorbike fees.
2.10 LIABILITY
We are not responsible for any loss, injury or damage sustained by Customers. Additional expenses incurred due to delays, accidents, natural disaster, political actions and unrest must be borne by Customers.
2.11 RESPONSIBILITY AND DISCLAIMER
We shall always do its utmost to provide the Services to the best of its capacity and upon the satisfaction of the customer. We act only in the role of agent for its travelers in making arrangements for transportation or other services which are incidental to the travel that is being purchased. As a broker for those travelers, we create the following disclaimers: It does not assume any liability whatsoever for any injury, damage, death, loss, accident or delay due to any action of any carrier, hotel, restaurant, business or person rending someone of those services included in the tour. It also reserves the right to decline to accept or to retain any person as a part of their excursion.
2.12 CLAIMS
All disputes, claims, and litigation regarding the Services shall first be settled by way of discussion and mutual understanding. In case such negotiation and agreement might be neglected, the disputes, claim, or litigation shall be finally resolved by the mediation of the Vietnam International Arbitration Centre (VIAC) at the Chamber of Commerce and Industry of the Socialist Republic of Vietnam. All claims must be submitted in writing within 30 days after the end of this Service.
2. TERMS OF THE AGREEMENT
3. DISCLAIMER
Considering that:
- Party A is a company operating in the field of providing tour services and has been granted an international travel service business license No. 02 – 028/2025/CDLQGVN-GP LHQT by the Ministry of Culture, Sports and Tourism.
- Party B is a customer who needs to use and participate in one or more tours organized by Party A.
The parties agree to sign a commitment to waive liability during Party B's participation in tours provided by Party A with the following terms:
Article 1: Purpose of the Commitment
a. This commitment is signed to clarify the scope of responsibility of each Party during Party B's participation in tours provided by Party A.
b. By signing the contract, registering, paying, and/or using any services provided by Party A or its partners within the tour chosen by Party B, Party B acknowledges that it has read, understood, and fully agrees to the terms of this Commitment.
Article 2: Commitments of Party B
a. Party B commits to complying with the instructions and regulations from the tour guide, manager, and staff of Party A throughout the preparation and participation in the tour. Party B shall fully comply with regulations on personal safety, environmental protection, fire safety, current Vietnamese laws, landscape protection, and regulations at the destinations during the tour.
b. Party B agrees that Party A may modify and change the itinerary of the tour chosen by Party B to ensure safety. In this case, Party B understands and complies with all instructions from Party A and will not claim any compensation from Party A.
c. Party B agrees to terminate the trip at Party A's discretion if it is unable to complete any stage of the trip due to Party B's health/physical condition. Party B agrees to bear all expenses incurred (accommodation, airfare, transportation) if the trip ends unexpectedly due to personal reasons or Party B's health/physical condition.
d. Party B is fully responsible for its own equipment and tools and any equipment and tools provided (if any).
e. Party B understands and acknowledges that travel always involves risks that may affect personal health, life, and property, including but not limited to: falls, sudden weather changes, insects, accidents during travel, lack of medical facilities, etc.
Party B agrees to assume full responsibility for all risks arising, including direct or indirect risks throughout the trip, except in cases where there is clear evidence of direct and serious fault on the part of Party A.
Article 3: Cases of Exemption from Liability for Party A
Party A shall not be liable for the following cases:
a. Regarding Party B's personal information:
• Party A is not responsible for the accuracy of the information provided by Party B.
• Party A is not responsible if Party B's personal information is leaked due to security breaches on Party B's equipment (such as virus infections, malware, etc.) or intentional access by a third party.
• Party A is not responsible if Party B's system experiences problems during access, payment, or is attacked via an external website.
b. Party A is not liable for compensation if the trip is delayed, changed, or canceled due to force majeure events such as natural disasters, epidemics, strikes, war, changes in immigration policies, technical failures of transportation, etc.
c. Party A is not responsible for the quality of service provided by third parties, including but not limited to: trip cancellation, delays, lost luggage, unsatisfactory service, etc.
d. Party A is not responsible for consequences caused by Party B's personal actions such as violating the law, using stimulants, causing disorder, or failing to comply with general regulations.
e. Party A shall not be liable if Party B experiences health problems during or before the trip that are not declared in advance (including pregnancy, underlying medical conditions, etc.), or for adventurous trips with potential risks that Party A has informed in advance, unless the health problems occur due to Party A's direct fault.
f. Party A shall not be liable for loss, misplacement, or damage to personal property or money.
The face, personal belongings, identification documents, etc., during Party B's participation in the trip.
Article 4: General Commitments
a. This commitment shall become effective from the time Party B completes the booking and confirms the service through the online system (including but not limited to payment, deposit, or written confirmation via email/WhatsApp).
b. Party A and Party B agree to fulfill all terms and conditions stated in this commitment in good faith and with full responsibility.
c. This commitment is considered legally valid without a physical signature. The electronic confirmation, booking record, and payment transaction shall serve as official evidence of agreement between both parties.
d. This commitment may be stored electronically by both parties and shall have equal legal value as a signed hard copy.
CONFIRMATION
By completing the booking, Party B confirms that they have read, understood, and agreed to all terms and conditions stated above.
